Terms & Conditions
Skiddle Limited (trading as Skiddle.com) of 4 Balcarres Road, Aston on Ribble, Preston PR2 2BT ("Skiddle.com", "We", "Us")
agree to provide to you the event promotor ("You", "Your") or you the customer ("You", "Your")
the services as described in this document subject to the terms and conditions
of this document ("Terms").
Advertising
By advertising your event with the Skiddle.com Promotion Centre, you
agree to the following Terms:
THE SERVICE
* As set out on the Skiddle.com
website (“Site”), you may list details of the event (“Event”)
submitted by you to Skiddle.com for publication on the Site.
* The “Service” will include:
* provision of an easy to use, categorised directory to advertise your
Event
* tools to enable you to manage the content of your listing;
* optional ticket sales services (at an additional cost)
* promotional tools such as Eflyers and SMS campaigns to increase the
profile of your Event. USE
* You agree to use the Service strictly in accordance with these Terms.
OWNERSHIP
You warrant and agree that:
* You are associated with the Event (an Event Promotor or Venue Promotor)
and have the right and authority to advertise the Event.
* You are over 18 years of age and are legally entitled to enter into these
Terms.
YOUR EVENT LISTING CONTENT
* You confirm and warrant that the details, description, information and any
images submitted for publication by Skiddle.com on the Site are true and accurate
and contain no false statements, misrepresentations or omissions which may mislead
any interested parties over the details of the Event.
* You agree that you are solely responsible for the content and accuracy of
any listing that you post on the Site.
* You agree that you shall indemnify Skiddle.com in full and hold it harmless
for any losses or damages howsoever arising, including claims from third parties,
that may result directly or indirectly from any listings that you post
on the Site.
* Skiddle.com reserves the right to suspend or terminate (at its sole discretion)
the publication of your listing on the Site in the event that it is made
aware by whatever means that the content is inappropriate, misleading or inaccurate,
without liability to you. In such circumstance Skiddle.com will notify you of
the suspension or termination.
* Any listings giving rise to complaint or dispute of any kind shall be suspended
pending resolution or otherwise terminated. Skiddle.com may in its sole discretion
reactivate the listing upon receipt of satisfactory proof that such a
dispute or complaint has been resolved or otherwise satisfied. In no event shall
Skiddle.com be required to act in respect of any dispute or complaint other
than to suspend or terminate the listing.
* Listings which infringe any law or regulation (or potentially are infringing)
containing foul or otherwise inappropriate language, offend or infringe
the rights of any third party (including intellectual property rights)
will be removed immediately, without warning or liability to Skiddle.com.
RENEWAL, DURATION & REMOVAL OF YOUR EVENT LISTING
* Weekly listings (those for Events occuring on a regular, weekly basis) will
be added to the system for 12 week periods. It is your responsibility to renew
these listings after this period has expired. In order to keep our database
up-to-date, we reserve the right to delete any Events from our database that
have not been renewed.
* Should we be unable to contact you via the current e-mail address you provide
on your listing, and it appears this e-mail is no longer functioning,
we reserve the right to delete your listings, and suspend your account without
liability to us.
* You agree to update the listing within a timely manner (maximum 48 hours) should
the Event be cancelled or rescheduled. You may remove the listing, or amend the
content to show the change in details.
* All featured event listings (those with increased promotion throughout
the site) carry an listing fee.This must be paid in advance of the listing
going live. In the event that the fee is not paid the listing will be
removed forthwith.
* If you contact us to request the deletion of the Event listing, we can
only remove your listing with proof that you are the original advertiser.
YOUR CONTACT DETAILS
* You understand that it is essential to provide a working and correctly submitted
e-mail address in order to receive any communications from Skiddle.com.
* You are responsible for checking that your contact details on your listing
are correct and kept up-to-date at all times to ensure enquiries reach
you.
* Skiddle.com cannot be held responsible for any e-mail problems you experience,
whether a result of your Internet Service Provider, the Internet or any
other technical issue.
* We reserve the right to contact you as required to inform you of changes
to the service or upcoming promotional activities. We will not pass your
details to any other party.
EFLYER DISTRIBUTION
* The provision of Eflyer Distribution describes the service whereby Skiddle.com
will send your email marketing message ("Message") to our list of
opt-in subscribers.
* Messages must not contain images for the sole intention of tracking exposure
and/or the receipt of messages.
* If the content of the message is being hosted by you, it is your responsibility
to ensure this is available for at least 48 hours after the message has been
sent.
* We will endevour to send the message at the time and date requested by you.
However the distribution of the email messages is dependant upon external factors,
such as internet traffic which are beyond our control.
* We will not be held responsible for non-delivery of messages due to a technical error or problem,
as long as we have attempted to send the message as required.
* You agree that you shall indemnify Skiddle.com in full and hold it harmless
for any losses or damages howsoever arising, including claims from third parties,
that may result directly or indirectly from any eflyer distributed by us.
* Skiddle.com reserves the right to suspend or terminate (at its sole discretion)
the publication of your eflyer in the event that it is made aware by whatever
means that the content is inappropriate, misleading or inaccurate, without liability
to you. In such circumstance Skiddle.com will notify you of the suspension or
termination.
YOUR LISTING ON EXTERNAL WEB SITES
* You agree to your Event listing appearing on other web sites selected by
Skiddle.com for the further marketing of your Event.
* You agree that your Listing may not appear or be available on all the
sites specified all of the time. Please allow up to one working days for
your Listing to appear on external sites (this also applies to any future
modifications you make).
* You understand that external sites have may different formats for Event details.
As a result some information you have submitted to Skiddle.com may not appear
on external sites.
* You agree that external sites which Skiddle.com specifies it publishes your
Event details may change from time to time without notification. No refunds
can be given should Skiddle.com no longer publish to certain sites that were
listed at the time of your Event submission.
* Event listings will remain on the Site until the date of the Event. We cannot
guarantee this will be the case with external websites.
* You agree that Skiddle.com has no control over the level of service, quality,
accuracy and downtime of external web sites and Skiddle.com accept no liability
howsoever arising for any losses that may arise as a result of your Event details
being listed on an external website.
PROMOTION REFUND POLICY
* Your event listing/banner/other promotion will be turned live within one working day of receipt of payment
of the Fee (usually instantly). Please note that once your listing/banner/other promotion is made
live, our service is deemed to be fully delivered and we are only able to issue refunds
at the discretion of our management team.
* No refunds will be offered for temporary or permanent loss of Service howsoever
arising, including but not limited to a loss of Service due to the Skiddle.com
website being unavailable for whatever reason.
* No refunds will be given if we delete your listing/banner/other promotion listing as a result
of a breach of these Terms and Conditions on your part.
* Should we have to terminate your advertising period prematurely for reasons beyond your control, refunds may be offered at the discretion of the management, up to and not exceeding the value of the unused advertising period, calculated on a pro-rata basis.
* This does not affect your statutory rights as a consumer.
* In no event will Skiddle.com be liable to you whether by way of a refund or in
any other respect in the event that Skiddle.com ceases to trade for whatever reason.
* The total liability of Skiddle.com to you, howsoever arising under these Terms
in respect of the Service, shall be limited (to the extent permitted by law)
the total Fee paid by you for the Service.
COPYRIGHT
* By submitting the Event to Skiddle.com you warrant that you own the copyright
in details, including imagery, that you submit and grant us a licence to use
the Event details to provide the Service and for publicity when promoting the
Site and the Property.
DATA PROTECTION
* Skiddle.com respects your privacy and shall manage your personal details
strictly in accordance with its policy on data protection which may be found
at http://skiddle.com/w3c/policy1.html
PHOTOGRAPHIC COPY
* It is noted that all photographic copy and imagery on the skiddle.com site and related domains remains the property of skiddle.com and should not be reproduced digitally or via print media unless express permission is granted in advance by a designated spokesperson of skiddle.com. There is normally a fee for this service.
* Any reproduced image must by credited to skiddle.com and/or the creator of the image. This includes all gallery photos which may have been taken by users directly unknown by skiddle.com. This credit should be clearly published alongside the said image.
* All use of Photographic and/or other imagery is subject to advanced approval and a proof may be requested before publication.
* Failure to comply with these terms results in an automatic fine of £250 (two hundred and fifty pounds sterling) plus V.A.T which will be invoiced automatically to the publisher. Payment of this will become due for payment within 7 days of invoice and if payment is not made by this date then skiddle.com will take further action in form of court proceedings.
* Any proceedings of whatever nature shall be held at the County Court Preston, Lancashire or the High Court Preston District Registry at the discretion of skiddle.com. Please note that any costs of and occasioned by this action will be paid by yourself plus interest therof pursuant to provisions of Section 69 of the County Court Act 1984 at such rate and such period as the Court shall think fit.
GENERAL
* You understand that Skiddle.com cannot guarantee attendance at your Event
as a result of submitting the Event to Skiddle.com, nor can Skiddle.com
guarantee enquiries or the legitimacy of enquiries.
* Skiddle.com reserves the ultimate discretion as to which listings, if any, are
in violation of these terms.
* Skiddle.com reserves the right to alter these terms at any point and without
notification.
* These Terms represent the entire agreement between Skiddle.com and you and all
warranties and representations save as are expressly set out in these Terms
are hereby excluded, to the extent permitted by law.
* These Terms shall be governed by the laws of England and Wales and the parties
hereby submit to the exclusive jurisdiction of the English Courts.
SKIDDLE OFFERS - Promotors Conditions
* By using this service you must be in a position to ensure that the offer is accepted by staff of the venue or associated event. It is your responsibility to ensure that the offer is accepted as advertised.
* Random checks will be made to ensure the discounts are being offered fairly.
* If the offer listed has conditions of use, please ensure they are clearly stated and published on the skiddle.com website. Any changes to these conditions must be published at least 72 hours prior to the event date.
* Details of skiddle members can be made available upon request should further verification be required.
* Skiddle will promote the offers through the member pages which are local to each member. They may also be promoted nationally but this is not guaranteed.
* You reserve the right to withdraw discounts or offers, but it is your responsibility to update the offers on Skiddle.com as soon as possible, should you choose to do this.
* Skiddle.com reserve the right to remove any offers from the website without prior notice should any of these terms or conditions be breached.
THE SKIDDLE.COM SHOP
Purchase Policy
Skiddle.com sells tickets on behalf of promoters, bands and venues which means Skiddle.com does not set the ticket prices. Policies set forth by our clients, such as venues and theatres, prohibit us from issuing exchanges or refunds after a purchase has been made or for lost, stolen, damaged or destroyed tickets.
Tickets purchased on Skiddle.com may be subject to a per ticket booking fee charge and postage charges if applicable.
Skiddle.com aim to post event tickets within 7 days of purchase. This may differ for some events where our ticket allocation is not fulfilled until closer to the event. If this is the case, you will be informed of the target delivery date after your order has been confirmed. We can only post tickets to the billing address of your credit card
Occasionally, events are cancelled or postponed by the promoter or venue for a variety of reasons. If the event is postponed you will be contacted with the new event details. If you cannot attend, or the event is cancelled, please contact us for instructions on receiving a refund for the face value of the tickets. Please note that we cannot refund postage if your tickets have already been sent to you. Booking fees are non-refundable.
Ticket Sales Conditions
- As an authorised ticket agent, Skiddle.com sells tickets on behalf of the venue, promoter or producer that produces the event for which you buy a ticket. We refer to the venue, promoter, or producer from whom we obtain tickets to sell to you as our "Event Partner". Tickets may be withdrawn and admission refused at any time upon refunding the printed purchase price. Ticket should be purchased for personal use only, Tickets may not be resold or offered for resale by anyone whether at a premium or otherwise and may not be used for advertising, promotion or for any other trade purposes. Resale or attempted resale will result in your ticket being cancelled without refund or other compensation. The Event Partner and its affiliates, successors, or assigns may enforce these terms in accordance with the provisions of the Contracts (Rights of Third Parties) Act 1999 (the Act).
- It is your responsibility to check your tickets; mistakes cannot always be rectified.
- It is your responsibility to ascertain whether an event has been cancelled and the date and time of any rearranged event. If an event is cancelled or rescheduled, we will use reasonable endeavours to notify ticket holders of the cancellation once we have received the relevant authorisation from the Event Partner. We do not guarantee that ticket holders will be informed of such cancellation before the date of the event.
- We regret that tickets cannot be exchanged or refunded after purchase unless the performance is cancelled. If a performance is cancelled, ticket holders will be offered seats at any rescheduled performance (subject to availability) up to the face value of the tickets or, if the ticket holder is unable to attend the rescheduled performance or the performance is not rescheduled, a refund of the face value of the ticket.
- This ticket is issued subject to the Rules and Regulations of the venue and Event Partner. Full details are available at the venue box office. Breach of any of these Rules and Regulations or any unacceptable behaviour likely to cause damage, nuisance or injury shall entitle the venue or Event Partner to eject you from the venue.
- The venue reserves the right to refuse admission should patrons breach any Rules and Regulations of the venue or Event Partner. The venue may on occasions have to conduct security searches to ensure the safety of the patrons.
- Every effort to admit latecomers will be made at a suitable break in the event, but admission cannot always be guaranteed.
- We will not be responsible for any tickets that are lost or stolen after purchase.
- We will always endevour to post tickets with plenty of time for their arrival before the event. However, it is your responsibility to order tickets in plenty of time to allow for their delivery, especially if you are leaving early for an event.
- We will not be responsbile for the late arrival of tickets for reasons beyond our control - such as postal strikes (unless we have posted the tickets using a guaranteed service, such as Special Delivery).
- Tickets are sold subject to the venue or Event Partner's right to alter or vary the programme due to events or circumstances beyond its reasonable control without being obliged to refund monies or exchange tickets.
- No refunds can be offered for tickets purchased without prior agreement with the Event Partner.
- The venue, Event Partner and Skiddle.com accept no responsibility for any personal property.
The ticket holder has a right only to a seat of a value corresponding to that stated on the ticket and the venue or Event Partner reserves the right to provide alternative seats to those specified on the ticket.
- There will be no pass-outs or re-admissions of any kind.
- Ticket holders consent to filming and sound recording as members of the audience.
- Tickets may be restricted to a maximum number per person. We reserve the right to cancel tickets without prior notice purchased in excess of this number.
- Unless otherwise stated, you must be 18 years of age or older to purchase tickets and attend the events listed. Many venues now participate in the Challenge 21 scheme and you may be asked to show approved ID to gain entry if you look under 21
- Neither the venue, the Event Partner, nor Skiddle.com shall have any further liability beyond the face value of the ticket purchased plus the relevant per ticket booking fee.
- All of these terms and conditions are governed by English Law.
